Freedom of Information Act Policy and Fees

The South Carolina Commission on Prosecution Coordination (SCCPC) complies with the requirements of the South Carolina Freedom of Information Act (FOIA), S.C. Code Ann. 30-4-10, et seq. SCCPC follows the definitions, procedures, and exemptions listed in FOIA. In addition, there may be other state and federal restrictions or protections  that apply to records requested from SCCPC, and SCCPC abides by all such law protective of certain information.

Under the provisions of FOIA, SCCPC has 10 days (or 20 business days for requests for records over two years old), excluding Saturdays, Sundays and official public holidays, in which to inform the person making the request of its determination and the reasons for it. If the request is granted, the record must be furnished or made available for inspection no later than 30 calendar days from the date the final determination was provided, unless the records are more than two years old, in which case SCCPC has 35 calendar days.

If a financial deposit is required by the public body (see below under “Fees”), the record must be furnished or made available for inspection no later than 30 calendar days from the date the deposit is received, unless the records are more than two years  old, in which case SCCPC has no longer than 35 calendar days from the date the deposit was received.

Under S.C. Code Section 30-2-50, it is a crime to knowingly obtain or use personal information from a public body for commercial solicitation directed to any person in this State. Violation of this statute is punishable by a fine of up to $500 or imprisonment up to one year, or both.

Fees and Deposits

SCCPC charges reasonable costs for providing documents. Fees will be assessed uniformly. Any reduction or waiver in fees must be approved in advance by the Commission’s Executive Director.

Requestors will also be charged for any expenses actually incurred by SCCPC in retrieving the requested information or documents (such as archival retrieval fees).

These fees are subject to change.

 

FOIA does not require SCPC to create an electronic document if one does not already exist. However, if requested and SCCPC, in its discretion, agrees to covert records into electronic format, the per page copying charge does not apply, but there will be an additional charge for staff time for converting to electronic format.

A deposit of up to 25 percent of the anticipated total cost may be required prior to processing a request. The full balance must be paid at the time of production of the records. SCCPC does not accept cash or personal/business checks. Payment must be made by cashier’s check or money order only (payable to “SC Commission on Prosecution Coordination”) in payment.

Submission of FOIA Requests

A FOIA request can be made for any non-exempt public record of the SCCPC. FOIA does not require SCCPC to create new records or to conduct research, analyze data, or answer questions when responding to requests.
